TERMS AND CONDITIONS FOR COMPETITIONS

LUKAS SCHMIDT Wein GmbH (hereinafter referred to as "raffle organizer") occasionally offers competitions and prize draws. Participation in these competitions/prize draws is subject to the following terms and conditions.

§ 1 Competition

The prize draw can be carried out by the raffle organizer in cooperation with various partners (cooperation partners). The raffle organizer represents the cooperation partners during the competition and promises the prizes donated by them solely in their name. The raffle organizer is not obliged to provide any service of its own, unless it is itself the sponsor of the prize in the specific case.

§ 2 Participation

(1) Only adults are eligible to participate.
(2) A person takes part in the competition by answering all of the competition questions and sending them to the raffle winner or by fulfilling the competition conditions. The participant is responsible for the accuracy of the information required for the competition, in particular the email address. The competition answers must be received within the deadline specified in the competition. The electronically recorded receipt serves to verify compliance with the deadline.
(3) To participate in the competition, it is essential that all personal details are true. Otherwise, exclusion may occur in accordance with Section 3 (4).

§ 3 Exclusion from the competition

(1) Employees of the raffle winner, the cooperation partners involved in the competition and their relatives are excluded from participation.
(2) In the event of a breach of these conditions of participation, the raffle organizer reserves the right to exclude persons from the competition.
(3) Persons who use unauthorised aids or otherwise gain advantages through manipulation will also be excluded. In such cases, winnings may also be subsequently revoked and reclaimed.
(4) Anyone who provides false personal information may be excluded from the competition.

§ 4 Implementation and processing

(1) The winners will be notified in writing by the raffle and, if you give your prior consent, their names can be published on www.lukas-schmidt-wein.de or on the website of the respective cooperation partner. The winner expressly agrees to this form of publication. The raffle is entitled to transmit the winner's data to the cooperation partner in order to enable the prize to be delivered. If the raffle only knows the winner's email address, the winner will be notified by email. If the winner does not respond within four weeks of the notification being sent, the right to the prize expires and a new winner will be chosen by lot.
(2) Cash payment of the prizes or any substitute prizes is not possible under any circumstances.
(3) The claim to the prize or prize substitute cannot be assigned.

§ 5 Early termination of the competition

The raffle organizer reserves the right to change the conditions of participation at any time. The raffle organizer also reserves the right to terminate or interrupt the competition or prize draw at any time for important reasons without prior notice. This applies in particular to reasons that would disrupt or prevent the competition or prize draw from running as planned. If such termination is caused by the behavior of a participant, the raffle organizer is entitled to demand compensation for the damage caused from that person.

§ 6 Data Protection

All personal data of the participant will be stored and used exclusively for the purpose of carrying out and processing the competition or prize draw. The participant is free to withdraw his/her participation in the competition/prize draw at any time. § 7 Liability

(1) The raffle organizer is released from all obligations upon delivery of the prize, unless these regulations stipulate an earlier date.
(2) The raffle organizer is not liable for material and/or legal defects in the prizes donated by any cooperation partners.
(3) The raffle organizer is only liable for damages caused by the raffle organizer or one of its vicarious agents intentionally or through gross negligence or through the violation of cardinal duties. This above limitation of liability does not apply to damages caused by injury to life, body and/or health.

§ 8 Final Provision

(1) Legal recourse is excluded.
(2) The law of the Federal Republic of Germany shall apply exclusively.
(3) Should any of these provisions be or become invalid, the validity of the remaining terms of use shall remain unaffected.
